At Otolane Inc. (“Otolane”), we believe the privacy of our users is critically important. This privacy policy (this “Policy”) outlines and explains the ways in which we collect and handle your information.  We are committed to limiting the collection and use of personal information to the extent necessary to administer our business.

Otolane seeks to provide you with a positive experience during your visit to the website located at www.otolane.com (or any successor to it) and any services, content or functionality available through or on the website and any Otolane mobile applications (collectively, the “Services”), while respecting your personal privacy.

By submitting personal information to Otolane, by conducting business with Otolane or by using Otolane's services, you agree to the terms of this Policy and expressly consent to the collection, processing, use and disclosure of your personal information for the purposes set out in this Policy.


Scope of Policy


The information provided in this Policy covers your interactions via the Services including the features, applications, emails, content, downloads, products and services offered through the Services. Certain portions of the Services may only be accessible to registered users and such access may be subject to additional terms and conditions.

This Policy does not apply to other companies’ web sites or services or links that you may access via the Services.  Information collected or received by these third parties is subject to third party privacy policies. 


Information Collection, Usage and Disclosure


Our web servers track and collect information about your visit to our website.  We collect these statistics to determine the number of daily visitors to our website, the types of browsers our visitors use, the visitors' domain names and countries of origin. We use this for purposes of optimizing the website experience and continuous improvement.  Some of the information collected by Otolane may be personal information. Otolane’s mobile applications may also disclose certain permissions for certain device settings (e.g., CAMERA). The information we collect is used to improve the content and quality of the Services.

Otolane uses information that is collected for the following general purposes to:

  • verify information you have provided to Otolane;

  • assist with collecting any amounts owed by you to Otolane;

  • contact you in response to any of our business activities with Otolane or any questions, requests, complaints or comments you may have;

  • contact you to provide you with information regarding Otolane's business;

  • provide advertisements to you through our website, email messages, mobile applications or other methods of communication;

  • administer surveys, contests or other promotional activities or events sponsored by us;

  • help us to develop, evaluate and improve our sales and marketing strategies and techniques;

  • operate and improve our website;

  • provide third parties with information necessary to permit that third party to conduct business with Otolane and/or effectively provide you with services; and/or

  • respond to legal process and reasonable inquiries from regulatory and/or investigative authorities.


Information is not shared with or sold to others for commercial purposes, except to provide the products or services you've requested, when we have your permission, or under the following circumstances:

  • to share personal and/or aggregated information that you have provided with our affiliates.

  • in the event it is necessary, to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms and conditions, or as otherwise required by law, regulation or governmental request.

  • in the event of a potential or actual acquisition of Otolane or its combination with another company.

  • Otolane may use contractors help deliver the Services. In addition, Otolane shares credit information concerning dealer with its affiliated companies, third party auctions and certain service providers.  We require contractors that have access to Otolane subscriber information to protect this information in a manner consistent with this Policy and prohibit them from using the information for any purpose other than to carry out the services they are performing for the Service.


Cookies


Cookies are small digital signature files that are stored by your web browser that allow your preferences to be recorded when visiting the website. In addition, cookies may be used to track your return visits to the website. You may be able to block cookies via your browser settings, but this may prevent you from accessing certain features of the website or the Services.


Messages, Statuses and Notifications


Otolane tracks the status of vehicles transacted via the Services and keeps buyers and sellers notified of these statuses as they occur.  By registering with the Services and agreeing to the terms and conditions and this Policy, you agree to receive vehicle status updates and notifications via your Otolane mobile application, text messages, desktop computer and your provided email address. Due to the complex technology behind dashboard messages and email notifications, Otolane cannot guarantee users will receive important information on the statuses of vehicles they are selling or buying.  It is the responsibility of users to monitor the Otolane website regularly and as needed to track their vehicle purchases and sales for important status changes.  


Security


Otolane takes commercially reasonable technical, physical and administrative measures to protect the confidentiality, integrity and security of your personally identifiable information. Of course, we cannot guarantee the security of your personally identifiable information on the Internet. The password-protected areas of the Service are secured by industry standard encryption. However, it is your responsibility to maintain the confidentiality of your password(s) and other user credentials. You are also required to log-in to your Otolane account after a certain period of time has elapsed to protect you against others accidentally accessing your account.


Ownership


The Services and any related content or materials are the property of Otolane or its licensors and are protected under applicable intellectual property and other laws.  Except as explicitly provided by Otolane, you may not transmit, display, reproduce, distribute, modify, create derivative works from, or otherwise exploit the Services.  Automated means, such as but not limited to scrapers or spiders, may not be used to collect and/or index any information contained on our sites. You may not reproduce, store, distribute, frame, or incorporate into another website, materials or intellectual property from our sites or services without the prior written authorization of Otolane.


Storage


All personal information you provide to Otolane is secured on servers with restricted access.  We will only store your personal information for as long as there is a business need for it in accordance with applicable record retention policies and a range of legal and regulatory recordkeeping requirements.


Consent, Changes and Opting Out


By using the Services, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us.  The term "processing” means using cookies on a computer/mobile device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in Canada.  We may update this Policy from time to time for any reason.  We will notify you of any changes to this Policy by posting the new Policy here and informing you via email or text message. We recommend that you consult this Policy regularly for any changes, as we will deem continued use as approval of all changes.  You can stop all collection of information by uninstalling the Otolane mobile applications.  You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.  You can also request to opt out via email at legal@otolane.com.
